Terms of Use | Fotime

By downloading, installing, or using Fotime ("the App"), you agree to these Terms of Use. If you do not agree, please do not use the App.

1. Acceptance of Terms

These Terms of Use govern your access to and use of Fotime. By using the App, you confirm that you are at least 13 years old (or the minimum age required in your jurisdiction) and agree to be bound by these terms.

2. Description of Service

Fotime is a photo management application that helps you organize and clean up your photo library through daily themed photo curation, smart duplicate detection, and AI-powered classification. All photo analysis is performed locally on your device.

3. User Responsibilities

You agree to:

  • Use the App only for its intended purpose of photo management
  • Not reverse-engineer, decompile, or disassemble the App
  • Not use the App for any unlawful or unauthorized purpose
  • Not attempt to interfere with or disrupt the App's functionality

4. Photo Access and Data

Fotime requires access to your photo library to function. By granting this access, you understand that:

  • All photo analysis occurs entirely on your device
  • No photos are uploaded to any external server
  • Changes you make (deletions, favorites) sync with your device's Photos app and iCloud
  • Deleted photos follow your device's standard deletion process (moved to Recently Deleted)

5. Subscriptions and Purchases

Fotime offers an optional Pro upgrade available as a monthly subscription, yearly subscription, or one-time lifetime purchase. Fotime Pro includes:

  • Unlimited daily photo browsing (free users are limited to 4 per day)
  • Unlimited duplicate and burst photo cleanup
  • Access to all card layouts and removal animations
  • View all large files in your library
  • Auto-play for Live Photos and videos

Regarding payment and billing:

  • Payment is charged to your Apple ID account upon confirmation of purchase
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
  • You can manage and cancel subscriptions in your Apple ID Account Settings (Settings > [Your Name] > Subscriptions)
  • No refunds will be granted for the unused portion of any subscription period
  • Prices may vary by region and are subject to change

6. Intellectual Property

The App, including its design, features, code, and content, is owned by the developer and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

7. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

To the maximum extent permitted by applicable law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the App, including but not limited to loss of data or photos.

9. Photo Deletion

You acknowledge that:

  • Deleting photos through the App permanently removes them from your photo library (subject to the standard "Recently Deleted" recovery period set by your device)
  • The developer is not responsible for any unintended deletion of photos
  • You are responsible for maintaining backups of your important photos

10. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

11. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the App.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to its conflict of law provisions.

14. Apple-Specific Terms

These Terms are between you and the developer, not Apple. Apple has no obligation to provide maintenance or support for the App. In the event of any failure of the App to conform to applicable warranties, you may notify Apple for a refund of the purchase price (if any); Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the App.
